Ewald Consulting Data Privacy Policy
Introduction
This Privacy Policy governs the privacy practices for Ewald Consulting (our “Company,” “we,” “our,” or “us”). We understand that you are aware of and care about your own personal privacy interests, and we take that seriously. This Privacy Policy applies to information provided to us when you visit or interact with us on our website (e.g., purchase goods and services, including event notifications, training, request information, sign up for our newsletters) through your user account or collected by us through our website and products (respectively “Site” and “Products”).
Applicability and Eligibility
This Privacy Policy applies to our collection, use, disclosure, and protection of your data. It does not apply to third party websites, applications, or services. This Privacy Policy specifies:
- What personal information do we collect about you through our Site and Products
- How is this information used and with whom it may be shared
- What choices are available to you regarding the use of your data
- What are our security practices to protect the misuse of your information
- How can you correct any inaccuracies in the information?

Collection and Use of Personal Information
We collect Personal Information about our clients and other customers. We are the owners of or have the rights to the information provided and/or collected through our Site and Products. Your information includes the information you provide in setting up your user account and any information or materials you provide for the Product you acquire through our Site. We only have access to/collect information that you voluntarily provide us via our Site, any email you send us, your user account, or other direct contact from you. We do not require you to set up a user account to use our Site, however you may elect to set up a user account to purchase or use our Products. For purposes of this Privacy Policy, “Personal Information” will include all personally identifiable information that is specific to you — which includes, but is not limited to, first name, last name, job title, employer name, work address, work email, and work phone number. As specified below, this Personal Information is used to provide clients and customers with the Products. This information may be combined with information already in our possession or made available to us through other information we are licensed to receive, and/or information we obtain from other sources. We may also collect information as a result of your interaction with any of our Site, our newsletter(s), or any communication received directly or indirectly from us. This means we may collect information from you through multiple locations, not just the initial one of our Sites through which you register. Except as specifically noted herein, we will not provide any Personal Information you may provide to us or we collect through our Site and Products to any unaffiliated third party without your express consent. We do not sell Personal Information to anyone and only share it with third parties who are facilitating the delivery of our Products.
Clients
When you become a client of Ewald Consulting or subscribe to a newsletter, we collect information about you including (but not limited to) your name, your employer’s name, your work address, and your email address. We may also collect your personal email address, a personal mailing address, and a mobile phone number. Clients may voluntarily provide additional information in their profile, such as information about their educational background, number of years in the industry, etc. Clients may edit their profile at any time to change, add, or remove Personal Information.
We process your Personal Information to deliver client benefits, and to inform you of our events, content, and other benefits or opportunities associated with your status as a client. We may also use this information to help us understand our clients’ needs and interests to better tailor our products and services to meet your needs.
Events and Webinars
We host events throughout the year, including our webinars, trainings and other events (collectively “Events”). If you are a client and register for one of our Events, we will access the information in your member account to provide you with information and services associated with the Event. If you are not a client and you register for one of our Events, we will collect your name and contact information, which we will store in our database and use to provide you with information and services associated with the Event. If you are a presenter at one of our Events, we will collect information about you, including your name, employer and contact information, and photograph, and we may also collect information provided by Event attendees who evaluate your performance as a presenter. As an attendee or speaker, we will keep a record of your participation to provide you with post-Event information including details on upcoming Events you may be interested in.
We reserve the right to use any photograph/video taken at our Events, without the express written permission of those included within the photograph/video, as set forth in the Event Registration Agreement. We may use the photograph/video in publications or other media material produced, used or contracted including but not limited to: brochures, invitations, books, newsletters, magazines, television, websites, social media, etc. To ensure the privacy of individuals, images will not be identified using full names or personal identifying information without written approval from the photographed subject.
Publications
You may wish to subscribe to some of our publications without becoming a client. To receive our mailings/newsletters by email, you will need to create a profile with us, which involves providing us with at least your first name and last name, an email address, and the country in which you live. We do not share this information with any third party other than as required to store the information in our database and provide you with the requested publication (e.g. providing name and address to mail houses or publishers of print publications, use of third-party software for electronic mailing).
You may manage your subscriptions by subscribing or unsubscribing at any time. If you have any difficulties managing your email or other communication preferences, please contact us at info@ewald.com.
Correspondence Information
If you correspond with us by email, the postal service, or other form of communication, we may retain such correspondence and the information contained in it and use it to respond to your inquiry; to notify you of our events, publications, or other services; or to keep a record of your complaint, accommodation request, etc. Users may opt out of receiving certain communications by following the unsubscribe process described in an email communication, or by contacting our office directly.
Your Rights
Certain tools and settings are provided to help you access, correct, delete, or modify your personal information. You may opt out of any future contact from us at any time. Depending on where you live, you may have certain legal rights under applicable law. For example, you may have the following rights:
- Right to limit – means you can ask us to restrict or stop processing your Personal Information, if it not necessary for the purpose you provided it to us.
- Right to access – means you can ask us for a copy of any Personal Information we have about you, if any.
- Right to correct – means you may ask us to change and/or correct any Personal Information we have about you.
- Right to delete – means you may ask us to delete any Personal Information we have about you and we will be happy to do so unless we are required to retain such information by law or regulation, or we have a right to retain subject to a user agreement for our internal business purposes.
- Right to transfer – means you may request a copy of your Personal Information, in a commonly used and machine-readable format, be provided to you or to a third party you specify.
You may contact us at any time about any of these rights or any concern or question you have about our use of your Personal Information. We welcome you to contact us regarding the information we have collected about you, including the nature and accuracy of the data collected about you, to request an update, modification, or deletion of your information, to opt out of certain services, or to withdraw any consent you may have granted. Please note that if you choose to delete your information or opt out of the collection and use of your information, certain features may no longer be available to you.
Payment Information
We may collect and store information related to purchases if you choose to purchase Products from us. You may provide certain information to complete payments, including your credit or debit card number, card expiration date, CVV code, and billing address (collectively, “Payment Information”), along with your name and billing, and shipping address, to complete payment transactions. Per PCI Compliance, we do not accept credit card information via email. Credit card information received via fax, phone, or mail is entered into a secure system and then deleted and destroyed.
Website Usage
As is true of most other websites, our Site collects certain information automatically and stores it in log files. We may collect information about you through your use of our Site and Products with software application tools and data files, such as cookies, web log files, internet protocol (IP) addresses, the region or general location where your computer or device is accessing the internet, browser type, operating system and other usage information about the use of our Site, including a history of the pages you view, unique device identifiers, device hardware and OS information, and information relating to your login of your user account (“Usage Information”). We use this Usage Information to help us design our Site to better suit our users’ needs. We may also use your IP address to help diagnose problems with our server and to administer our Site, analyze trends, track visitor movements, and gather broad demographic information to assist us in identifying visitor preferences. Our Site also uses cookies and web beacons. It does not track users when they cross to third party websites or provide targeted advertising to them, and therefore does not respond to Do Not Track (DNT) signals. You can control such Usage Information through the control settings on your device. You may be required to permit such Usage Information to login into your user account or use our Products. Our use of Usage Information does not allow us to gather Personal Information from your device.
Other Uses of Personal Information
We use your Personal Information as necessary to maintain your user account. In addition, we may use either Personal Information or Usage Information we collect, or you provide to us, to:
- Respond to any questions you ask or to respond to the reason you contacted us. We do not share your Personal Information with any unaffiliated third party, unless necessary to respond to your request.
- Enhance, improve and develop new services and products and for overall customer support.
- Perform data analytics for our internal business purposes.
- Communicate with you (via email, text, phone or mail) either directly or indirectly through our marketing service provider to send you special offers, or marketing information related to our products and services.
- Communicate with you to notify you of changes to our Privacy Policy.
- Assess our products and services.
You have the right at any time to unsubscribe to any marketing communication from us and we will promptly honor such request.
We use the Usage Information to perform data analytics, analyze and evaluate the features and functionality of our Site and Products. We may also use Usage Information to process automatic crash reporting which collects reports of crashes, other technical issues, and information relating to how our Site and Products are functioning.
Sharing Information
Information about your purchases is maintained in association with your profile account. The Personal Information we collect from you is stored in a database hosted by a third party, ActiveCampaign. ActiveCampaign does not use or have access to your Personal Information for any purpose other than cloud storage and retrieval.
Usage Information may also be provided to ActiveCampaign and other certain third-party service providers as necessary to provide our Site and Products, and related functionality and offer other services and products. Third-party service providers, in addition to our data sources, may include software development, application and data hosting, wireless network services providers, and any digital marketing services (collectively “Third-Party Providers”). We are responsible for assuring that these Third-Party Providers comply with the terms of this Privacy Policy.
Except for our Third-Party Providers, we will not share Personal Information or Usage Information with an unaffiliated third party without your prior authorization, unless doing so is necessary (1) to enforce this Privacy Policy, to comply with law, regulation or other legal processes or to protect the rights, property or safety of us or others, (2) to comply with a valid order or process from a public authority, (3) to protect against misuse or unauthorized use of our Services or the user accounts, (4) to detect or prevent criminal activity or fraud, or (5) in the event that we or substantially all of our assets are acquired by one or more third parties as a result of an acquisition, merger, sale, reorganization, consolidation or liquidation, in which case such information may be one of the transferred assets.
Links
Our Site may provide hyperlinks to other websites. In addition to producing original content, we also subscribe to news feeds and blogs produced by others, which we link to from our Site. This means you may find yourself on our Site or reading an email where we will offer you a link to another organization’s website for additional relevant content. At these times, you will be leaving our Site. We are not responsible or liable for content provided by these third-party websites or the Personal Information they may happen to gather from you. These external websites have their own privacy policies and terms of use, which may be posted on their external website.
Our Site also uses interfaces with social media sites such as Facebook, LinkedIn, Instagram and others. If you choose to “like” or share information from our Site through these services, you should review the privacy policy of that service. If you are a member of a social media site, the interfaces may allow the social media site to connect your site visit to your personal data.
Security
We take precautions to protect your Personal Information, including reasonable physical, administrative, and technical safeguards. When you submit Personal Information via our Site and Products, your Personal Information is transmitted using secure sockets layer (SSL) encryption technology. We restrict access to your Personal Information to our authorized personnel and/or Third-Party Providers as appropriate and necessary to provide our Site and Products and/or maintain your user account.
We keep your Personal Information if it is necessary to process your requests, operate our business and provide our Site and Products, or as long as we are legally required to do so. For as long as we have your Personal Information, we will continue to protect the privacy and security of such Personal Information consistent with the Privacy Policy.
Children’s Online Privacy Protection Act
In compliance with the Children’s Online Privacy Protection Act, 15 U.S.C. § 6501.06 and 16 C.F.R. §§ 312.1 – 312.12, we do not knowingly collect information from children under the age of 13, nor do our Products target children under the age of 13. By using our Site and Products and any user account, you represent that you are not younger than 13.
Cross-Border Transfers of Personal Information
Our systems are located in the United States and we may also locate systems in other locations where we or our service providers maintain facilities. Unless otherwise requested by our clients, backups made from locations within the European Economic Area remain within the European Economic Area. The storage location(s) are chosen in order to operate efficiently, to improve performance, and to create redundancies in order to protect the data in the event of a server outage or security incident.
We may transfer personal data from the European Economic Area and Switzerland to other countries, some of which have not been determined by the European Commission to have an adequate level of data protection. When we do, we use a variety of legal mechanisms, including contracts, to help ensure your rights and protections travel with your data; such contracts will conform to the standard clauses specified under the GDPR and we will remain liable for the protection of such Personal Information.
If you are located anywhere outside of the United States, please be aware that information we collect, including Personal Information, may be transferred to, processed in, and stored in the United States. By accessing our Site or Platform or providing us with Personal Information, you consent to the transfer, processing, and storage of Personal Information in the United States.
Personal Information is processed according to the provisions of this Privacy Policy and the requirements of applicable law wherever the data is located. If you are located outside of the United States, please be aware that data protection laws in the United States may differ from those of the country in which you are located, and your Personal Information can be subject to access requests from governments, courts, or law enforcement in the United States in accordance with and subject to the laws of the United States.
Changes and Updates to the Privacy Policy
By using this Site, you agree to the terms and conditions contained in this Privacy Policy. As our organization and benefits change from time to time, this Privacy Policy is expected to change as well. We reserve the right to amend the Privacy Policy at any time, for any reason, without notice to you, other than the posting of the amended Privacy Policy on our Site. We may email periodic reminders of our notices and terms and conditions and will email clients of material changes.
